South Korea’s Ex-President Yoon Indicted for Abuse of Power

Yoon Suk Yeol, the former president of South Korea, has been indicted for abuse of power as of July 19, 2023. This indictment follows a series of investigations into his controversial declaration of martial law last year, which has intensified the ongoing insurrection probe.

On December 3, 2022, Yoon’s actions sparked a significant political crisis when he attempted to impose martial law by deploying troops to the National Assembly. His goal was to prevent lawmakers from voting against this declaration. This marked a historic moment, as Yoon became the first sitting president in South Korean history to be taken into custody. He was arrested in January 2023 after weeks of resisting arrest, during which he allegedly used his presidential security detail to obstruct investigators.

Following his initial detention, Yoon was released in March 2023 on procedural grounds, despite his trial for insurrection charges still being underway. The situation escalated last week when authorities issued a new arrest warrant, expressing concerns that Yoon might destroy evidence relevant to the case.

Prosecutor Park Ji-young confirmed the indictment, stating that Yoon faced multiple charges, including abuse of power and obstruction of special official duties. According to Park, Yoon did not adhere to the necessary protocols required for declaring martial law, such as convening a meeting with all cabinet members. Additionally, he has been charged with the alleged “drafting and discarding a false document” that falsely indicated endorsements from the prime minister and defense minister regarding the martial law declaration.

Despite being detained, Yoon has refrained from attending questioning sessions. However, he did appear in court on Friday to contest the warrant for his arrest. His legal team reported that Yoon defended himself for over 30 minutes, citing “limited physical mobility and the challenges he was facing.” The court ultimately rejected his request to cancel the warrant.

Currently, Yoon is being held in solitary confinement in a cell equipped only with a fan and lacking air-conditioning during a severe heat wave affecting South Korea.
